Welcome to Sidetracked. The terms “we,” “us,” and “our” refer to Sidetracked. Sidetracked operates this store and website, including the information, content, features, tools, products, and services made available through it (collectively, the “Services”).

Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.

These Terms of Service (“Terms”), together with the policies referenced below, govern your access to and use of the Services and purchases made through our store.

Please read these Terms carefully. They contain important information about your legal rights, including limitations of liability and warranty disclaimers.

By accessing, interacting with, purchasing from, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

SECTION 2 — OUR PRODUCTS

We make reasonable efforts to accurately represent our products, including their colors, materials, dimensions, fit, and appearance. However, colors and other visual details may appear differently depending on your screen, device, lighting, and display settings.

Some Sidetracked products are produced on demand by third-party manufacturing and fulfillment partners. Because of the nature of garment production, printing, embroidery, washing, dyeing, and finishing processes, minor variations between individual items may occur and do not necessarily constitute a defect.

Product descriptions, designs, pricing, availability, and specifications may be changed at any time without notice. We may discontinue products or limit quantities available to any person, geographic region, or jurisdiction.

SECTION 3 — ORDERS

When you submit an order, you are offering to purchase the products in that order. We reserve the right to accept, reject, limit, or cancel an order where reasonably necessary, including in cases involving suspected fraud, payment issues, inventory or fulfillment problems, pricing errors, or violations of these Terms.

Payment must be successfully authorized before an order can be processed.

Many Sidetracked products are made to order and may enter production shortly after an order is placed. For this reason, we cannot guarantee that an order can be changed or canceled once production has begun.

Please review your product selection, size, color, shipping address, and other order details carefully before completing your purchase.

Returns, replacements, and refunds are governed by our Refund Policy.

SECTION 4 — PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price applicable to your purchase is the price displayed when your order is submitted, subject to correction of obvious pricing or technical errors.

Unless otherwise stated, listed prices do not include applicable taxes, shipping charges, customs duties, import fees, or similar charges.

You agree to provide accurate and current billing, payment, shipping, and contact information and represent that you are authorized to use the payment method submitted with your order.

SECTION 5 — SHIPPING AND DELIVERY

Shipping and delivery dates are estimates and are not guaranteed.

Some Sidetracked products are made to order and require production time before shipment. Production and delivery times may vary depending on the product, destination, carrier, order volume, and other circumstances.

We are not responsible for delays caused by carriers, customs processing, incorrect or incomplete shipping information supplied by the customer, weather, service interruptions, or other circumstances outside our reasonable control.

If an order appears to be lost, damaged in transit, or otherwise affected by a delivery problem, please contact us at sidetracked.hq@gmail.com so we can investigate and determine the appropriate resolution.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Keep this section exactly as Shopify supplied it.

They explicitly tell merchants not to modify it, so I wouldn’t.

SECTION 10 — PRIVACY POLICY

Replace the [LINK] placeholders with your actual Shopify Privacy Policy link once you’ve published it.

I would otherwise leave this section substantially unchanged.

SECTION 16 — DISCLAIMER OF WARRANTIES

Keep Shopify’s legal language, but change every instance of:

to whatever your actual legal/trading entity name is once that’s finalized.

Same for Sections 17 and 18.

SECTION 22 — GOVERNING LAW

The existing wording is unnecessarily vague. Since Sidetracked operates from California, I’d make it:

These Terms of Service and any separate agreements through which we provide the Services will be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law principles.

To the extent permitted by applicable law, any dispute arising from or relating to these Terms or the Services will be brought in the state or federal courts located in Los Angeles County, California, and you and Sidetracked consent to the jurisdiction of those courts.

Nothing in these Terms limits any rights or remedies available to consumers under applicable law.
